The agreement
By downloading, installing, or using Roast My Snack ("the app", "the service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the app. These Terms form a binding agreement between you and [LEGAL ENTITY NAME] ("we", "us"). Our Privacy Policy is incorporated by reference.
Eligibility
You must be at least 13 years old to create or operate an installation of the app on your own. Children under 13 may use the app under the direct supervision of a parent or legal guardian who has read and agreed to these Terms and the Privacy Policy on the child's behalf.
If you're using the app on behalf of an organization (a clinic, a school, a household), you represent that you have authority to bind that organization to these Terms.
Your license to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices you own or control, for personal, non-commercial purposes, subject to these Terms and Apple's standard Licensed Application End User License Agreement (EULA).
The license does NOT permit you to:
- Copy, modify, or create derivative works of the app
- Reverse-engineer, decompile, or disassemble the app
- Rent, lease, sublicense, or resell access to the app
- Use the app to build a competing service
- Remove or alter any proprietary notices
Your content
You retain ownership of the photos you submit ("User Content") and the comics generated for you. By submitting a photo, you grant us a limited, worldwide, royalty-free license to process that photo solely to provide the service: identification, scoring, and comic generation. We don't claim ownership of your snacks or your kid's lunchbox.
You represent that:
- You have the right to submit the photo (either you took it, or you have permission)
- The photo does not depict another person's child without consent of that child's parent or guardian
- The photo does not violate any law or third-party right
The generated comics are yours to share, post, and remix for personal, non-commercial use. If you share a comic publicly, we ask (but don't require) that you credit "Made with Roast My Snack". Commercial use of generated comics requires written permission. Email hello@roastmysnack.com.
Acceptable use
You agree NOT to:
- Submit photos that aren't of snacks (we reserve the right to reject and discard non-snack imagery)
- Submit photos of identifiable people other than incidental hands or arms holding the snack
- Submit photos that depict illegal activity
- Probe, scan, or test the vulnerability of our backend
- Use automated tools to access the service at scale
- Attempt to extract our prompts, model weights, or other proprietary information
- Impersonate any person or misrepresent affiliation
- Use the app to harass, bully, shame, or harm any person, including the kid eating the snack
The point of the app is to roast the snack, never the kid. Any output that crosses that line is a bug. Tell us about it.
Not medical or nutritional advice
Roast My Snack is entertainment. The scores, comics, and Glow-Up Swap suggestions are generated by AI and reviewed informally by the team. They are NOT medical advice, dental advice, or nutritional advice. Do not use the app to diagnose, treat, prevent, or manage any health condition, allergy, or dietary requirement.
For real questions about your child's diet, allergies, or oral health, consult a licensed pediatrician, pediatric dentist, or registered dietitian.
Service availability
We aim for high uptime but make no guarantee. The service may be unavailable due to maintenance, third-party outages (notably OpenAI or our hosting provider), or for reasons beyond our control. We may modify, suspend, or discontinue any part of the service at any time, with or without notice.
Third-party services
The app depends on third-party services including OpenAI (for AI processing), Apple (for distribution and notifications), and Vercel (for hosting). Use of those services is also subject to their respective terms. We are not responsible for their actions, outages, or terms changes.
Disclaimers
The app is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the app will be error-free, that defects will be corrected, or that the app or the servers that make it available are free of viruses or other harmful components.
Limitation of liability
To the maximum extent permitted by law, in no event will [LEGAL ENTITY NAME], its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the app, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to these Terms or the app will not exceed the greater of (a) the amount you paid us for the app in the twelve months prior to the claim, or (b) one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold harmless [LEGAL ENTITY NAME] from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the app, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party right.
Termination
We may suspend or terminate your access to the app at any time, with or without cause, with or without notice. You may stop using the app at any time by deleting it from your device. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
Changes to these terms
We may update these Terms from time to time. Material changes will be posted to this page with a new "Last updated" date and, for significant changes, surfaced inside the app on next launch. Continued use of the app after changes go into effect constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of [STATE/COUNTRY], without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the app will be resolved exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to personal jurisdiction in those courts.
